Boys are also over-represented, especially those who are over the age of 10 years. In recent years, concern has been expressed about providing short breaks to children who have complex health needs, not only because of the knowledge that is needed to provide good care but also because of anxiety about litigation if something goes wrong. This is a particular issue if the person providing the care is not a parent and is not a registered nurse. Such concerns have led some local authorities to introduce restrictive policies that prohibit placements with any non-parent carer who is either an employee of the authority or an agent of it.

In Kirp’s view, these reflect a cultural tradition of individualism by which the USA is stereotyped. In contrast, UK practice is dominated by what Kirp calls ‘professionalization’, wherein stra­ tegically placed or dominant professional groups control or act as ‘gatekeepers’ to procedures, processes, resources and so on. A much more important point remains however. There is a range of somewhat bewildering, confusing and sometimes contradictory legislation, the cumulative effect of which would seem to be hindering rather than helping to support individuals experiencing special educational needs, by diverting pro­ fessionals away from their principal task of delivering such support.
