The absence of consent could result in the patient suing for trespass to the person. The failure to provide sufficient relevant information could result in an action for negligence. These two different legal actions will be considered separately. Trespass to the person A trespass to the person occurs when an individual has not given consent and either apprehends a touching of his person (this is technically known as an assault) or is actually touched (this is known as a battery). The person who has suffered the trespass can sue for compensation in the civil courts (and in certain cases a criminal prosecution could also be brought).

They recommended that: l l l patient satisfaction would be improved by making comment cards available to patients so that their perceptions of staff could be recorded; that management needed to foster good patient/staff interaction by providing feedback to staff and by providing them with opportunities for improvement in social skills; and that some reward system should be put in place both to motivate staff and to bring about a greater identity of staff with their department. There are clear advantages in obtaining the patient's consent in writing if there are any risks inherent in the treatment or investigation or if there is likely to be a dispute later as to whether consent was actually given. Completing the form should ensure that all the requisite information is recorded. The guidance also recommends a form to be completed when an adult who lacks mental capacity to give consent to treatment is provided with care in the absence of consent (see below).
